New Gas/Petroleum Law and Mining Law for Mozambique

On the 21 April 2015 in Maputo, the market briefing on both the new Gas & Petroleum Law as well as the new Mining Law for Mozambique takes place at the Radisson Blu, Maputo.

The main focus of the market briefing is to focus on key elements of the new Laws pertaining to foreign companies working in Mozambique and the new requirements presented regarding:

  • The promotion and development of Local Content policies and practice
  • Local content requirements for the procurement of goods and services for petroleum operations which are designed to promote the development of Mozambican businesses and knowhow
  • Legal requirements of companies operating in the mining, oil and gas sector are required to provide employment and technical training for Mozambican nationals, with a preference for the population residing in the immediate vicinity of the concession area and the associated 95% and 5% quota
  • The limitation of tax incentives and the new tax frameworks
  • These include a requirement for foreign persons to associate themselves with Mozambican persons to supply goods and/or services to the mining, oil and gas sector in Mozambique
  • Processing and export of unprocessed minerals
  • The Rovuma Basin Decree Law
  • Upcoming legislative changes in local content decree law, immigration law, quota systems, and labour law

Local content although not a new concept, is implemented with varying degrees of success in mining and oil and gas producing countries. Many mining, oil and gas producing countries are/have introduced requirements for ‘local content’ into their regulatory frameworks. These requirements aim to create jobs, promote enterprise development and accelerate the transfer of skills and technologies. Local content has therefore become a strategic issue for the oil and gas industry—presenting both challenges and opportunities.

The market briefing is aimed at assisting the mining, oil and gas industry efforts to develop good practice in managing local content. It is aimed at practitioners and other company representatives with responsibility for this objective.
